Landmark Auction Co. LLC – Terms and Conditions

Welcome to Landmark Auction Co. LLC ("Company," "we," "us," or "our"). By using our website (bidwithlandmark.com), participating in an auction, or making a purchase, you agree to comply with the following Terms and Conditions.

1. User Accounts

  • Users must create an account to participate in our auctions or make purchases.
  • Account registration is required before bidding and is prompted when clicking on an item link.
  • Users must be at least 18 years old to participate.

2. Auction & Bidding Rules

  • All bids are binding. Once placed, bids cannot be retracted or canceled.
  • A buyer’s premium is added to the final bid price. The percentage varies by auction platform but typically ranges between 18-23%.
  • If a winning bidder fails to pay, they will be reported and permanently banned from future auctions.

3. Payment Terms

  • We accept payments via credit cards, PayPal, and Venmo.
  • Payment is due immediately after the auction ends. The credit card on file will be charged automatically.
  • Failure to complete payment may result in account suspension and a permanent ban from our auctions.

4. Item Descriptions & Warranties

  • All items are sold "as-is, where-is," with no warranties or guarantees.
  • Bidders may inspect items by appointment before placing bids. Contact us to schedule an inspection.
  • We make every effort to accurately describe items, but we are not responsible for misinterpretations by the bidder.

5. Shipping & Pickup Responsibilities

  • Winning bidders will receive an email and text after the auction to choose shipping or local pickup.
  • Buyers selecting local pickup must schedule a pickup time.
  • Items must be picked up within 7 days of the auction closing.
  • If a buyer fails to pick up their items within 7 days, they may be resold, donated, or disposed of at our discretion.

6. Cancellations & Bidding Errors

  • Bids cannot be canceled. Bidders should carefully review their bids before placing them.
  • Auction disputes or bidding errors should be reported by contacting us directly.

7. Limitation of Liability

  • Landmark Auction Co. is not liable for any damages, including lost profits, lost data, or any incidental, consequential, or special damages arising from participation in our auctions.
  • We are not responsible for lost, damaged, or delayed shipments once an item has been transferred to the shipping carrier.
  • Buyers assume all risks associated with bidding and purchasing items through our platform.

8. SMS Terms & Conditions

8.1 Program Description

By subscribing to Landmark Auction Co. LLC text message notifications, you agree to receive SMS communications regarding:

  • Account Notifications (registration confirmations, password resets, bid status updates, payment confirmations)
  • Customer Support & Alerts (responses to inquiries, issue resolution)
  • Auction Updates (upcoming auctions, bid reminders, closing alerts)
  • Order & Delivery Notifications (pickup instructions, shipping updates)
  • Marketing & Promotions (flash sales, discounts, special offers)

8.2 Opt-In & Consent

By providing your phone number and opting into SMS notifications, you consent to receive text messages from Landmark Auction Co. at the number you provided. Consent is not a condition of purchase.

8.3 Opt-Out & Unsubscribe

You may opt out of our SMS communications at any time by replying STOP to any message you receive. Once you opt out, you will no longer receive text messages from us unless you re-enroll.

8.4 Message & Data Rates

Message and data rates may apply depending on your mobile carrier and plan. Landmark Auction Co. LLC is not responsible for any charges incurred from receiving or sending text messages.

8.5 Supported Carriers

Our SMS notifications are supported by major U.S. carriers; however, Landmark Auction Co. LLC cannot guarantee message delivery to all carriers or mobile devices.

8.6 Privacy & Data Security

Your privacy is important to us. We do not sell, rent, or share your mobile number with third parties for marketing purposes. For more details on how we handle your data, please review our Privacy Policy.

8.7 Changes to SMS Terms

Landmark Auction Co. LLC reserves the right to modify or terminate the SMS notification program at any time. Any changes will be posted on this page.

9. Changes & Updates to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after any updates constitutes acceptance of the new terms.
